The Administrative Law Judge issued an important ruling on September 7, 2005 regarding the proposed Belleayre Resort at Catskill Park. His ruling pertains to the issues raised at the "Issues Conference" held in the summer of 2004 in Middletown, Delaware County. The intervening parties (including the Catskill Center as a member of the Catskill Preservation Coalition) raised many issues that they thought were substantive and significant and which could have an adverse impact on our communities and environment. The Judge agreed that in fact 12 issues, virtually all of the issues raised by the CPC, should move forward for further investigation in court-like proceedings or adjudication. This is a victory for protecting our environment, our community character and our sense of place in Catskill Park. The Judge was particularly concerned with the potential negative impacts on the Catskill Forest Preserve, specifically, the Big Indian Wilderness Area and the Slide Mountain Wilderness Area. This is one more step in a long review process. The applicant can now appeal this decision to the Commissioner of the NYSDEC.
